Over the course of this semester you read chapters on controversial court rulings and decisions some in which you may or may not have agreed with. That is the beauty of Cyber Ethics, Law , & Policy. There is no one size fits all approach to the subject matter. For your final paper you will be asked to write a case brief on one of the following cases:

  1. Verizon v. FCC
  2. Reno v. ACLU
  3. U.S. v. Alkhabaz
  4. Elonis v. United States
  5. Martin v. Hearst Corporation

You may be asking yourself how you should format this case brief. There are many examples on the internet on formatting but some of the most important things that you should include in the case brief is the following:

  • Title
  • Reporter Publisher
  • Court & Year
  • Procedural posture (how it got to the court of appeal)
  • Statement of facts (narrative story)
  • Issues of appeal (issues that were decided on appeal)
  • Arguments (arguments on each side)
  • Policy implications (different ways that the judged could have gone)
  • Black letter law
  • Rationale (appellate that judges used to make a decision)
  • Dissents (any particular dissenting or concurring opinions)

Now this is not law school so I will not be excepting law student final product but I will be expecting you to cite any and all sources and follow APA formatting for citations. I highly recommend using Marymount Library legal databases in order to search for the cases.
